The present conditions aim at defining the methods of remote sales between ACCESSOIRES ESSENTIELS and the Consume’ actor, from the order to the payment and until the delivery. They regulate all the stages necessary to the placing of the order and ensure the follow-up of this order between the contracting parts. The present general conditions of sale apply to all orders placed to Internet site www.accessoiresessentiels.com.

The order implies irrevocable adhesion in the general conditions of sale. These general conditions of sales being able to be the subject to modifications, the applicable conditions are those in force on  www.accessoiresessentiels.com at the date of placing the order by the Consume’ actor.

The Consume’ actor states to have the capacity to conclude this contract i.e., to have the legal majority and not to be under supervision or trusteeship, or to behold a parental authorization enabling him to carry out an order under this contract.

3.  Products

3.1. Information

The products sold by ACCESSOIRES ESSENTIELS are those being reproduced on the website www.accessoiresessentiels.com , on the day of the visit of the web site by The Consume’ actor.

The products sold are described and presented with greatest possible exactitude making it possible to respect the Article L 111-1 of the Code of the consumption, which envisages the possibility for the potential consumer of knowing before the final order taking the essential characteristics of the products that it wishes to buy.

3.2. validity of the offers

The offers presented by ACCESSOIRES ESSENTIELS are valid only within the limit of stock. ACCESSOIRES ESSENTIELS reserves the right to modify the set of the products, their times of availability and their prices, according to constraints  imposed by the suppliers and/or manufacturers and to inform of it The Consume’ actor.

3.3. conformity of the offers

The offered products are in conformity with the French legislation in effect and the applicable standards in France. The photographs, texts, graphics, information and reproduced characteristics and illustrating the products presented are not contractual. Consequently, if errors, omissions or modification of these known as characteristics by the suppliers and/or manufacturers had suddenly occurred in this presentation, the responsibility for ACCESSOIRES ESSENTIELS could not be committed.

If, in spite of its vigilance, the products are inalienable,   will apply the Article L. 121-20-3 of the Code of the Consumption, according to which, in case of defect of execution of the sale by ACCESSOIRES ESSENTIELS, resulting from the unavailability of the good or the ordered service, The Consume’ actor will be informed of this unavailability as soon as possible by e-mail. It is agreed between The Consume’ actor and ACCESSOIRES ESSENTIELS, that ACCESSOIRES ESSENTIELS commit themselves, within 30 days as from the date of the order, either to deliver the product ordered to The Consume’ actor, or to carry out a refund.

Final unavailability could not be the responsibility of ACCESSOIRES ESSENTIELS, nor  open right to damages for The Consume’ actor

In the event of out-of-stock condition on one of the products of an order, ACCESSOIRES ESSENTIELS will dispatch all the other products available of the order.

ACCESSOIRES ESSENTIELS is liable with full regard to The Consume’ actor of the good execution for the obligations resulting from the sale concluded remotely, that these obligations are to be carried out by ACCESSOIRES ESSENTIELS or other service providers, without damage from its right of recourse against those. However, ACCESSOIRES ESSENTIELS can exonerate whole or part of its responsibility while bringing the proof that the non execution or the bad execution of the sale is ascribable, either in The Consume’ actor, or with the fact, unforeseeable and insurmountable, of a third to the sale, or with a case of absolute necessity .

4. Prices/Tariffs

4.1. Price - VAT

The prices are indicated in Euros (€) All Inclusive of tax (including all taxes) and except share in the expenses of treatment and forwarding  (see in paragraph 8), invoiced in supplement and indicated before the final validation of the purchase order except particular mention or conditions.

The prices are subjected to the French VAT. and any change of the statutory rate of this VAT will be implicitly reflected on the price of the products presented on the site of ACCESSOIRES ESSENTIELS, without The Consume’ actor being informed beforehand from  it, at the date stipulated by the decree of application referring to it.

For the deliveries outside the French territory, the provisions envisaged by the Code General of the taxes relating to the VAT will be applicable.

ACCESSOIRES ESSENTIELS reserves the right to modify its prices constantly. The products will be invoiced on the basis of tariff in force at the time of the recording of the order.

4.2. transfer of property

ACCESSOIRES ESSENTIELS preserves the full and whole property for its marketed products until  complete cashing of all the sums due by The Consume’ actor within the framework of his order, expenses and inclusive of tax.

5. Order

5.1. data RELATED TO The Consume’ actor

The Consume’ actor must check the exhaustiveness and the conformity of the information concerning the address of delivery which he/she provides to ACCESSOIRES ESSENTIELS. The latter could not be held responsible for possible errors of seizure and the consequences which would result from this, such as a delay and/or an error from delivery.

In this context, ACCESSOIRES ESSENTIELS will cancel the order and will refund The Consume’ actor the price of the product ordered, the costs of the carriage remaining with The Consume’ actor.

Any order paid by cheque, will be treated only upon receipt of the means of payment. The availability deadlines as well as forwarding will have to be recalculated from the date of registration of this mode of payment.

5.2. nON PERFORMANCE of the order

ACCESSOIRES ESSENTIELS could not be held responsible for the non execution of the contract concluded in the event of unavailability or out-of-stock condition of the product, of force majeure, disturbance, strike or partial strike in particular related to the mail service and means of transport and/or communications, flood, fire.

ACCESSOIRES ESSENTIELS will not incur any responsibility for all consequential damages from the above mentioned, for trading loss, loss of profit, loss of chance, damages or expenses, which could occur from purchasing these products.
In the event of unavailability of the ordered product, in particular because of the suppliers and/or manufacturers, the Consume’ actor will be informed with earliest and will have the possibility of cancelling its order. The Consume’ actor will obtain the refund of the boxed sums (within 30 days at the latest following the date of cancellation of the order). In the event of impossibility of exchange, ACCESSOIRES ESSENTIELS reserves the right to cancel the order of The Consume’ actor and to refund the boxed sums to him.

5.3. share in the expenses of port

ACCESSOIRES ESSENTIELS reserves the right to invoice the Consume’ actor, a contractual participation corresponding to the expenses to deal with the order and to the forwarding costs. This required financial participation will be clearly stipulated on the site www.accessoiresessentiels.com .

5.4. confirmation of order

In accordance with the law of March 13, 2000 on the validity of the electronic signature, purchase order signed by The Consume’ actor by “double clicking” constitutes an irrevocable acceptance which can’t be called into question only in the cases specifically envisaged under the present general conditions of sales that is to say  the exercise of the right of cancellation and the insufficiency of stocks.

In the same way, clicking on the tab “validate your order” during the process of order, the Consume’ actor states to accept without reserve all these General Conditions of sale.

Contractual information will be the subject to a confirmation by email.

In case where some orders should be controlled by the quality department of ACCESSOIRES ESSENTIELS, the Consume’ actor will be, in this case, warned by email of the justifying documents to return in order to obtain the final validation of one’s order. Within the framework of a check up of the order, the Consume’ actor will have to send ACCESSOIRES ESSENTIELS, by mail or email, a readable photocopy recto-verso of a document justifying your residence. The order will be validated only after reception and checking of these elements. If these documents were not provided within 15 days according to the validation of the order by the Consume’ actor, this order will be automatically cancelled.

5.5. execution of the order

The Consume’ actor will be informed by email of the imminence of a consignment concerning its order.
This order will be carried out at the latest within a deadline from 48 hours to 5 days (except weekends and public holidays) from the date of final validation by ACCESSOIRES ESSENTIELS (after payment received and checking of order procedure carried out).

5.6. proof of the order

The data recorded by ACCESSOIRES ESSENTIELS are the evidence of the whole of the transactions carried out between ACCESSOIRES ESSENTIELS and its contractors. The filing of the purchase orders and the invoices will be carried out on a reliable and long lasting support being able to be produced in the event of litigation.

5.7. cancellation of the order

ACCESSOIRES ESSENTIELS reserves the right to cancel or refuse any order from a Net surfer with whom there would be a litigation related to the payment of a former order.

6. Payment

The orders are payable exclusively in Euros.

The invoice of the ordered products will be sent by email or if not possible otherwise, inthis in the parcel containing the ordered products.

6.1. validation

The payments by card are cashed on the day of the ordering from the Consume’ actor.

Cheques are cashed upon reception and before ACCESSOIRES ESSENTIELS dealing with the order

6.2. solvency/RELIABILITY of The Consume’ actor

ACCESSOIRES ESSENTIELS recommends to The Consume’ actor to be ensured of the solvency of its payment before validation of its order on the site. ACCESSOIRES ESSENTIELS reminds The Consume’ actor that any payment by bank card goes through a security system and that no number of bank card is kept in its files.
ACCESSOIRES ESSENTIELS reserves the right to suspend any management of order or any delivery in the event of refusal of authorization of payment on behalf of the financial organizations.

The Consume’ actor remains opinion that ACCESSOIRES ESSENTIELS could not be held for person in charge for any embezzlement or fraudulent use of an unspecified means of payment.

6.3. mode of payment

To regulate its order, the Consume’ actor has the choice, of all kinds of modes of payment suggested during the final validation of the purchase order, namely: bank card, cheque.

For a payment by cheque, the order is maintained during 10 working days. Beyond this time, without reception of the cheque, the order is cancelled.

In the event of payment by cheque, this one is only possible for cheques in euros, issued from a bank domiciled in France or in Monaco.

Any order paid by cheque will be handled only after cashing the payment. The deadlines of availability and of transportation will be recomputed from the date of registration of payment. The cheque will have to be written to the attention of ACCESSOIRES ESSENTIELS and sent to the address mentioned in paragraph 21.

The cards from foreign banks domiciled out of France must obligatorily be international bank cards. The payment is carried out by Paybox System, a protected solution used by our partner (Co-operative Credit). 6.4. entirety of the payment

The entirety of the payment must be carried out during the ordering, except for specific offers indicated on the site. The boxed sums could not be at all regarded as deposits or instalments.
ACCESSOIRES ESSENTIELS reserves in particular the right to refuse to carry out a delivery or to deliver an order from a Net surfer who would not have completely or partially paid a former order, or with which a litigation of payment would remain.

7. Geographical area

The sale on line of the products and services presented on the site is reserved to the net surfers who reside in one of the geographical areas specified in paragraph 8, hereafter.

8. Delivery

8.1. general

An order will be regarded as settled when the totality of the products is dispatched and that the Consume’ actor will have completely carried out the payment of the products and paid its share in the expenses of port.

8.2. methods

The products will be delivered to the address indicated by the Consume’ actor on the purchase order and only to the geographical area defined below

The choice of the means of transport will be made by ACCESSOIRES ESSENTIELS according to the weight and/or of the volume of the products.
ACCESSOIRES ESSENTIELS reminds the Consume’actor that he is expected to have mentioned all useful information for the delivery of his order.

8.3. reserves of use

The Consume’ actor has the legal and contractual obligation to check the physical state and the contents of the parcel at delivery, in the presence of the deliveryman.

Any anomaly concerning the delivery (damages, produced missing compared to the delivery order , damaged parcel, broken products, etc) will have imperatively to be indicated on the delivery form of the conveyor in the form of detailed, dated “handwritten reserves”, explicit and along with the signature of the Consume’ actor.
The Consume’ actor will have in parallel to point out this anomaly by sending to the conveyor, within two (2) working days  following the delivery date , a registered letter with acknowledgement of delivery explaining the mentioned complaints.
The Consume’ actor will have simultaneously to transmit copy of this mail (if necessary with the “report of damages” or the “statement of anomaly “obtained from the conveyor) by simple mail to: ACCESSOIRES ESSENTIELS, Customer service, 18A, Rue Henri Chevalier - Les Calmes - 69300 - CALUIRE - FRANCE
Any complaint arrived beyond the deadlines will be definitively rejected without possibility of recourse for the Consume’ actor.

8.4. anomaly/spoliation

Within the framework of a delivery carried out by a transport company, if the parcel arrives open and/or damaged (in particular with the presence of the safety Scotch tape) and that it is accepted with the delivery accompanied by “handwritten reserves ", it is ESSENTIELS that the Consume’ actor is obtaining a “statement of anomaly” by the mailman, the post office or the deliveryman. This form will have to be addressed to the Customer service of ACCESSOIRES ESSENTIELS so that they can start an investigation and implement a procedure of compensation, if necessary.

In the event of refusal of these goods upon delivery and in addition to the “handwritten reserves " to be specified, the Consume’ actor will have to ask the conveyor for resending this parcel to  the warehouse of ACCESSOIRES ESSENTIELS, BIOPORT, ZAC de l’Anjoly,

7, voie d’Angleterre, 13127 Vitrolles, accompanied by a “report of damages “(report 170) and keep a copy of this form, in case.

Within the framework of a delivery carried out by other conveyors, any parcel open and/or damaged, accepted or not upon delivery, will have to be accompanied by “handwritten reserves”. Those will have to be notified on the form of the deliveryman by the Consume’ actor, who will have to also inform by mail the conveyor and ACCESSOIRES ESSENTIELS within two (2) working days following the delivery.

Only the damage and anomalies mentioned in the reserves issued by the Consume’ actor will be taken into account in the resolution of the litigation by the conveyor.

ACCESSOIRES ESSENTIELS reminds that in the event of problem of delivery, the Consume’ actor must imperatively keep all the elements received as they are (packing and extra packing included) until complete resolution of its file.
Any failure to the rules defined above can generate the refusal of responsibility assumption of the litigation by the conveyor.

8.5. Free delivery

ACCESSOIRES ESSENTIELS offer the forwarding costs for a delivery in normal mode in Metropolitan France and in Principality of Monaco for any ordering of an amount equal to or higher than 120 €.

For any ordering of an amount lower than 120 € the expenses hereafter apply to the order of the Consume’ actor.

8.6.  PROCESS, Place, Tariffs and delivery periods

ACCESSOIRES ESSENTIELS re invoices only part of its expenses of treatment and forwarding its customers.

8.6.1. Mode

The delivery of any order is ensured by Colissimo by the Post office for the consignment of small or average (less than or equal to 30 kg or of which the product  L X L X H does not exceed 200 cm).

For the heavy or big consignments, ACCESSOIRES ESSENTIELS uses a private conveyor.

8.6.2. DEADLINES

By post office

From the time it is taken by the Post office, all orders ares delivered:

- within 48 H, working days for sending within Metropolitan France, Corsica and Monaco,

-  within 4 to 8 working days (starting from the date of forwarding) for the other European countries,

provided hours limit deposit.

By conveyor

The delivery in Metropolitan France or Monaco, is carried out at the latest within the 72 hours which follow the sending of the email of confirmation, subject to the closing times of post offices.

8.6.3. Place of delivery

The products are delivered to the address of delivery indicated during the order process. ACCESSOIRES ESSENTIELS deliver your order to the address of your choice (residence, place of work or other…). The address of delivery can differ from the invoicing address, in the case of a gift order for example.

8.6.4. Safety

Any order delivered by the Post office is delivered from Monday to Saturday between 9 a.m. and 12 H, in hand and against signature. In case of absence or of impossibility of handing-over  the parcel (no  janitor,…), the postman or the conveyor deposit a  note mentioning the date and the address of the post office where the parcel can be withdrawn on presentation of an identity document.

From the date mentioned on the note, you have 15 days to withdraw your parcel. At the end of this period, this one will be automatically returned to its shipper.

8.6.5. Traceability

Constantly, and thanks to the parcel number which is communicated to you by the commercial site (ex: 8V00300548899), you can follow your parcel by connecting you to the site www.laposte.fr/colissimo to know where it is.

8.6.6. Tariffs

The postage and packing are invoiced in addition to the selling price of the articles and is specified during the final validation of the order.

In order to meet your expectations as much as possible, ACCESSOIRES ESSENTIELS dispatches orders most places of the world by Colissimo from the Post office, as long as the weight (less than 30 kg) and the parcel dimensions (parcel  Size  ( length * width * height < 1;5 meters) allow it.

In the contrary, the parcel is dispatched by conveyor at an equivalent cost.

The tariff depends on the weight of the order.

For France, the minimum invoiced is 5,30 euros including all taxes.

COLISSIMO France

Stamping according to the weight with proof of deposit, delivery without signature, follow-up, commitment on the deadlines within 48 hours ⁽¹⁾ (2 working days).

Compensation integrated in the event of loss or damages of 23 €/kg (carriage costs included).

COLISSIMO Overseas

8.6.8. Delivery European COMMUNITY (except France) and Switzerland

ACCESSOIRES ESSENTIELS deliver your order to the following countries: Germany, Austria, Belgium, Denmark, Spain, Finland, Ireland, Italy, Luxembourg, Norway, Netherlands, Portugal, the United Kingdom, Sweden and Switzerland.

For Switzerland, the invoicing will be carried out in price net of tax (thus the VAT of 19,6% will not be charged to the customer). On the other hand, the Consume’ actor will be person liable to pay Swiss tax upon reception of the parcel.

8.6.9. Forwarding in several batches

If several forwardings are necessary for an order, this share in the expenses of treatment and forwarding will be invoiced only for one of the consignments.

8.6.10. Acceptance of delivery

ACCESSOIRES ESSENTIELS beholds the choice of the conveyor and warranties the good routing of the products. The transportation risks are left to the Consume’ actor ex works (as soon as the products leave ACCESSOIRES ESSENTIELS warehouse.

The Consume’ actor is expected to check the state of the packing and the conformity of the delivered product, and to issue if necessary any reserve on the delivery form of the conveyor.

If the conveyor is the Post office, the procedure to observe to be able to benefit from the right to return the parcel  is as follows:

- Implementation of the Colissimo procedure and refusal of the goods by immediately emitting a report of anomaly to the Post office employee (report 170),

- Implementation of refusal of the delivery to ACCESSOIRES ESSENTIELS within 48 hours as of the delivery date.  

Following up strictly this procedure is ESSENTIELS in order to be able to get a refund of goods damaged during transport. In particular, the presentation of the report of anomaly established with the conveyor will play an essential part. It should be noted that the return of the goods for breakage or damage during transport is ensured by the conveyor upon the refusal of the parcel.

In the case of a private conveyor, any anomaly concerning the delivery must be noted on the delivery order and mentioned as “handwritten reserves” as indicated in paragraph 8.3 and 8.4.

9. Taxes, royalties and right of customs for a delivery except France

Any order placed on the site www.accessoiresessentiels.com and delivered outside France could be subjected to additional taxes or royalties and customs duties which are imposed when the parcel arrives to its destination. These possible custom duties and taxes related to the delivery of a product are to be paid by the Consume’ actor and are upon its responsibility. It is not ACCESSOIRES ESSENTIELS responsibility to check and inform the Consume’ actor of the applicable customs duties and taxes.  In order to know them, the Consume’ actor must get information from the proper authorities in its country.

10. Right of cancellation

10.1. General

In accordance with the L.121-16 Article and following the Code of Consumption, the Consume’ actor has a right of cancellation during a timeline of seven (7) days, starting from the day of reception of the good from the sale.

However, when the seven days deadline expires on a Saturday, on a Sunday or on a public holiday , it is extended until the next first working day.

The Consume’ actor who uses his right of cancellation must, before returning the product, inform the Customer service of it.

10.2. Condition of exercise of the right of cancellation

The right of cancellation is granted to the Consume’ actor and shall be used in a discretionary manner.

The Consume’ actor, who returns the object, has neither to justify, nor to pay penalty.

This possibility of cancellation cannot take place if the products obviously used. The products must imperatively be returned correctly, in their original packing, in a perfect state of resale (not damaged, broken or dirtied, accompanied by all possible accessories, documentations…) duly sealed, with the following address: ACCESSOIRES ESSENTIELS, BIOPORT, ZAC of Anjoly, 7, way of England, 13127 Vitrolles.

When returning the goods, the Consume’ actor will have to also join the original of the invoice of which he will keep a copy. In the same way, if the product entails a  warranty form or any other document to be filled out, this one will not have to be filled so that the Consume’ actor can implement his right of cancellation. Any incomplete product, damaged, broken or of which the original packing will have been damaged, will neither be refunded nor exchanged. Any risk related to the return of the product is upon the charge the Consume’ actor.

The expenses for returning the goods in the event of cancellation are left with the Consume’ actor.

10.3. Refunding

The return of the products will give place to a refunding equal to the purchase price of the product. Refunding will not include the possible delivery expenses.

Transportation return costs are at the cost of the Consume’ actor who called for the right of cancellation.
The right of cancellation can also be used from the ordering and before the delivery. If it happens when the product has already been sent, the return expenses will be at the cost of the Consume’ actor.

As of the return, ACCESSOIRES ESSENTIELS will contact the Consume’ actor to inform him that his right of cancellation has been taken into account. Refunding will be done with a check.

10.4.  Restriction on the right of cancellation

In agreement with the Article L 121-20-2 of the code of consumption, the right of cancellation envisaged in the event of remote sale cannot be used, except if the parties agreed upon it differently, in case of agreements of supplying goods made according to specifications' by the consumer (here the Consume’ actor) or definitely personalized or who, because of their nature, cannot be reforwarded or are likely to worsen or of expire quickly.
The attention of The Consume’ actor is thus drawn to this potential restriction on the right of cancellation: the right of cancellation is not applicable to the sales of products personalized with its request.

11. Returns

11.1. Conditions necessary to the return

As from the date of reception of its order, the Consume’ actor has a time of seven (7) days to return a product. At the end of this period, the delivered products are considered in conformity and accepted by the Consume’ actor, and ACCESSOIRES ESSENTIELS reserves the right to refuse refunding.

To return a product the Consume’ actor must inform ACCESSOIRES ESSENTIELS customer service as a first step to obtain a code for the return.

The returned product must not be worn, is to stay in its original packing, with parts, accessories and various notes, will be upon the responsibility of ACCESSOIRES ESSENTIELS.

In case the procedures quoted above would not be respected, no complaint for nonconformity or apparent defect of the delivered products could be accepted.

The Consume’ actor who bought a defective product can require the refunding of the carriage costs.

Any request for refunding of the carriage costs will have to be formulated by The Consume’ actor on documents in proof and in limit of the cost of a consignment per colissimo registered with an insurance, if necessary. The requests likely to be accepted by ACCESSOIRES ESSENTIELS will be only if its responsibility is in cause and if the returned product matches the declaration of origin made by the Consume’ actor and confirmed by the After Sales Department.

11.2. Cost of the return

Except contrary provision envisaged by one of the products of these General Conditions of Sales, the cost of the return is supported completely by the Consume’ actor.

11.3.  return Address

The return of one or several products must be carried out to the following address:

11.4. Accompaniment of the return

The return of one or several products must imperatively be accompanied by an explanatory reason written as well as code return provided by the customer service. The Consume’ actor must also imperatively indicate if it wishes to obtain a refunding of his purchase.

Regarding any question related to the procedure of return, the Consume’ actor is to contact our customer service (refer to paragraph 21).

11.5. Treatment of the return

Upon reception of the returned parcel, ACCESSOIRES ESSENTIELS will acknowledge reception by email by indicating the action taken on the procedure of return.

11.6. Refunding

The Consume’ actor will receive his refunding by cheque within fifteen (15 ) day as from the date of reception of the returned  product. Only the price of the product will be refunded. Transport costs (delivery and return) are at the cost of the Consume’ actor.

12. Warranty

The delivered products are warrantied by the manufacturer of the product in the terms of Articles 1641 to 1648 of the French civil code. In no case the warranty suggested by ACCESSOIRES ESSENTIELS could be higher than that given by the manufacturer of the product.

The company ACCESSOIRES ESSENTIELS will be in no case held responsible for unforeseeable indirect or immaterial damage, for those related to a defective use of the product sold, for nonconformity with the needs of the Consume’ actor of the product sold not expressly cl:aimed and accepted with the order or of any other damage related to a cause not depending on the company ACCESSOIRES ESSENTIELS.

ACCESSOIRES ESSENTIELS guarantees the Consume’ actor, in case of hidden defects which can affect the delivered products, only within the framework of a replacement of the defective products, or parts making them unsuitable , without being able to be considered by the Consume’ actor as liable for the possible damaging consequences that these hidden defects could have involved.

In any case, the warranty does not cover:

- the abnormal and non conformity use of the products,
- damage being subject to a specific note in the instructions for use,
- defects and their consequences due to the interfering of the Consume’ actor or a repairer not approved by the manufacturer,
- defects and their consequences related to the non conformity use compared to the use for which the product is intended.

In the event of nonconformity of a sold product, it could be returned to ACCESSOIRES ESSENTIELS which will refund it.
All the complaints must be carried out in accordance with paragraph 13. The requests for refunding must be carried out by postal way to the address mentioned in paragraph 21, within thirty days from delivery.
The photographs are not contractual: a difference can exist between the photographic description of the product and its exact nature.

The warranty applies exclusively to the construction or malfunctions. It will play only if the material was used normally. The warranty will not apply to the defects out of which the cause is subsequent to the departure of products from the warehouse, in particular in the event of bad maintenance or of bad installation. Any damaging or tracks of intervention not carried out by the services of the manufacturer or from the company ACCESSOIRES ESSENTIELS immediately excludes the equipment concerned from the liability.

The warranty is exclusively limited to the replacement of the parts which will be recognized as defective by original parts or equivalent. In the case of parts considered to be defective under the responsibility of the Consume’ actor, those and the manpower will be invoiced to him.

13. Complaints

Any complaint must be communicated in writing within the week following the date of reception of the goods. The address to which any written complaint must be sent is that mentioned in paragraph 21.

ACCESSOIRES ESSENTIELS reserves the right to refuse the late complaints, which stop him from contacting the manufacturer or of an insurance company.

Any complaint must entail: the customer number, the Consume’ actor details, the  order number, references of the products and reasons for the complaint.

14. Responsibility

ACCESSOIRES ESSENTIELS declines any responsibility if the delivered product would supposedly not respect the delivery legislation related to a country other than France.

The products offered by ACCESSOIRES ESSENTIELS are in conformity with the French legislation in force.

ACCESSOIRES ESSENTIELS could not be held responsible for the non execution of the contract in case of unavailability or out-of-stock condition of the product, in case of force majeure, disturbance, in case of full or partial strike especially in post office and transportation or communication means.

ACCESSOIRES ESSENTIELS could not be held responsible for all consequential damages which could occur because of purchase of the products.

The responsibility for the company ACCESSOIRES ESSENTIELS could not be committed for the disadvantages and damage linked to the use of the Internet network such as a service rupture, the presence of data-processing viruses or external intrusions and more generally all cases considered as force majeure or considered by the court issued from third party.

In the same way, its responsibility could not be help responsible because of the contents of the sites to which the hypertexts can lead to from the www.accessoiresessentiels.com site.

ACCESSOIRES ESSENTIELS could not be responsible for any data or files losses. The Consume’ actor is held responsible for all necessary saving processes.

Total or partial impossibility to use the products can not imply the responsibility of ACCESSOIRES ESSENTIELS and can’t give place to any compensation or refunding.

The site also contains information coming from third parties, and links towards other Web sites. ACCESSOIRES ESSENTIELS will not in any case be held responsible for the damage resulting from the use of/for the access to/or the incapacity to use this external information, nor for the contents of other Web sites.

Moreover, in case of significant differences between the photographs of presentation of the products on the website, texts and illustrations and ordered products, ACCESSOIRES ESSENTIELS will not be held for responsible.

15. Intellectual property

The user who has an Internet site on a purely personal basis and which wishes to place, for a personal use, on its site a simple link returning directly in the banner page of the site of www.accessoiresessentiels.com, must obligatorily  be asking ACCESSOIRES ESSENTIELS for the authorization. It will not be considered in this case as an implicit convention of subsidiary. However, any hypertext link leading to the site www.accessoiresessentiels.com and using the framing technique (technique allowing to post on a site the pages of another site by preserving the scheme of presentation of the original site) or of in-line linking (technique allowing to insert an image, a text or sound resulting from another site)  is formally prohibited.

16. Force Majeure

ACCESSOIRES ESSENTIELS is not held responsible for any failure with its contractual obligations in case of  force majeure, including, but without being limited to, catastrophes, fires, internal or external strike, internal or external failures or breakdowns, the floods and fires, and generally any event not allowing the good carrying out of the orders.

17. Personal data protection

The personal information collected within the framework of the remote sale is compulsory, this information being necessary for the treatment and the delivery of the orders as well as for the writing out of the invoices. This information is strictly confidential and is intended only for ACCESSOIRES ESSENTIELS.
In accordance with the law n°78-17 of January 6, 1978 related to data processing, files and freedom, the personal data processing collected on the site www.accessoiresessentiels.com has been subject to a declaration with the National Commission of Data processing and Freedom. The Consume’ actor has a right of access, of modification, correction and suppression of the data related to it. To use this right, the Consume’ actor will have to contact ACCESSOIRES ESSENTIELS, as indicated in paragraph 21.

ACCESSOIRES ESSENTIELS uses cookies (computer file stored on the hard disk of the microcomputer of the Consume’ actor) in order to better personalize its service with the net surfers. The Consume’ actor keeps however the possibility of refusing the cookies by configuring its Internet navigator, thus losing the possible personalization brought by ACCESSOIRES ESSENTIELS.

18. Integrality and DURATION

On the assumption that one of the clauses of this contract would be null and avoid by a change of legislation, regulation or by a decision of court, that could in no case affect the validity and the respect of these general conditions of sale.

The present conditions apply throughout all the online settings of the services offered by ACCESSOIRES ESSENTIELS.

19. OWNERSHIP

The delivered goods will remain the property of ACCESSOIRES ESSENTIELS until their forwarding during the transfer to the conveyor, once The Consume’ actor will have paid in full the price principal and interests. The handing-over of a means of payment does not mean the payment is done. These provisions are no impediment for the transfer to the Consume’ actor of the risks of loss or damage. In the absence of integral payment, the company ACCESSOIRES ESSENTIELS will have the right to require the immediate restitution of the delivered material or its amount. The costs which could be implied for this restitution will be at full charge of the Consume’ actor.

20. Applicable duty and court of jurisdiction

The sales of products of ACCESSOIRES ESSENTIELS are subject to the French law. Any order placed implies the agreement of the Consume’ actor, and this without any restriction, with the ACCESSOIRES ESSENTIELS General Conditions of sale. On the assumption of a litigation that would come from this contractual relation, the Consume’ actor and ACCESSOIRES ESSENTIELS are committing themselves before any judicial action to look for a friendly solution. In the event of litigation, responsibility is given to the court from the proper jurisdiction in Lyon, notwithstanding plurality of defendants or call in warranty.
